The article investigates the significance of syntax in the multilingual EU law. It attempts to respond to the question whether syntax is apt to contribute to the uniformity of that law and how, with regard to this function, it relates to the (widely disputed yet uncontested) semantic and pragmatic methods of achieving such a uniformity. In order to respond to this question, the article firstly, recalls fundamental concepts which would help conceptualize the endeavour and, secondly, presents examples of analysis of (...) syntax arrangements which can be deemed representative for the study of the said problem of contribution. The study finds that EU law (expressed in 24 official languages which have equal authentic status) relies on diversified syntax of its respective constitutive languages. Syntax structures used in respective language versions of EU law represent narrower, law-specific, form of syntax structures available in these languages. Its specificity is determined mostly by legislative traditions of respective EU member states. Syntactic structures of EU law produced in different official languages do not represent a single pattern because of diversified mode of producing illocutionary value of provisions in which strongly idiomatic modal verbs (modal operators) and even special modal structures (not necessarily containing modal verbs) are used to express legal norms. They also differ when it comes to their law-specific compositionality, i.e. flexibility of different syntax structure to produce the same meaning and, in the same time, to preserve their genre/register informational value. Notwithstanding, these structures have well pronounced and system-significant common features within respective Germanic, Romanic, and Slavic families of languages in which EU law is mostly reproduced. The sentence structure and the relevant register of EU law provisions are the same for respective versions of EU texts of law expressed in the languages belonging to the respective three language families which were examined for the sake of this study. These common features are re-enforced by the synoptic mode of producing EU law which imposes formal resemblance of provisions reproduced in respective EU official languages to each other. The multilingual EU legislator also uses patterns which grant legal text the relevant register, yet its specific EU character ultimately transpires through semantic aspects of EU texts rather than their mere syntax. The unity of the system is achieved most strongly through the EU specific interpretation, where the teleological methods (which can be conceived as a language means to achieve EU law goals and objectives at the pragmatic level) are of utmost importance. Thus, there is no EU-specific syntax which would, as such, contribute to unity of EU law. Instead, unity is achieved in the area of semantics and pragmatics. The well exposed anaphoric character of EU law (as any other type of law) may contribute to narrowing down possibility for differentiation of respective language versions of EU law. (shrink)

‘The Final “Thank You”’ uses the work of Jacques Derrida and Friedrich Nietzsche to think the occasion of the 1995 rugby World Cup, hosted by the newly democratic South Africa. This paper deploys Nietzsche's Zarathustra to critique how a figure such as Nelson Mandela is understood as a ‘Superman’ or an ‘Overhuman’ in the moment of political transition. The philosophical focus of the paper, however, turns on the ‘thank yous’ exchanged by the white South African rugby captain, François Pienaar, and (...) the black president at the event of the Springbok victory. It is the value, and the proximity and negation, of the ‘thank yous’ – the relation of one to the other – that constitutes the core of the article.1. (shrink)

The Social Intelligence or Social Brain Hypothesis is an influential theory that aims to explain the evolution of brain size and cognitive complexity among the primates. This has shaped work in both primate behavioural ecology and comparative psychology in deep and far-reaching ways. Yet, it not only perpetuates many of the conceptual confusions that have plagued psychology since its inception, but amplifies them, generating an overly intellectual view of what it means to be a competent and successful social primate. Here, (...) I present an analysis of the Social Intelligence/Brain hypothesis highlighting how its anthropocentric origins have led us to be held captive by a picture of what social life involves and the kind of mind needed to navigate the social landscape. I go on to consider how experimental work in this vein either does not test what it claims to be testing, or introduces impossible problems regarding animal minds that cannot be solved, but only dissolved. What we need, in other words, is the application of “Wittgenstein's razor” and the reinvention of primatology along his enactivist lines. (shrink)

The school of separation accepts the existence of pre-existence world based on such foundations as inclusiveness of real sciences in revealed sciences, the authenticity of appearances, non-detachment of spirit, priority of creation of spirit over creation of body, separation between intellect and essence of spirit, and existence of worlds before this world. The pre-existence world is of great importance in this school due to its relation with natural cognition of monotheism, the reason of prophets’ mission, and the criterion of personality’s (...) identity. The theorists of this school provide transmitted reasons for the existence of pre-existence world, among which the tradition used in the commentary of verse 172, Chapter 7 is of special significance. This school provides solutions to those problems raised on the existence of pre-existence world. These problems are divided into two groups, one claiming that the existence of this world is impossible and the other one holding that the reasons provided for the realization of this world are not sufficient. There are five main problems is group one and two in group two. The answers provided for these two groups by theorists of this school are based on their principles, which are centered on transmitted reasons and criticism of foundations of each problem. (shrink)

Application of technologies has an important role in agricultural development. Identifying and assessing the impacts of agricultural technologies is necessary. This study aimed at assessing the impacts of laser levelling economically, socially, environmentally, and technically in the viewpoint of the agricultural experts and identifying factors determining their perception of the impacts. The study samples (151 experts) were selected using multi-stage random sampling in Fars Province, Iran. The results revealed that experts considered uniform distribution of water, using conservation tillage, facilitating agricultural (...) activities, decreased water consumption and decrease of water wasting as the most important technical impacts of laser levelling technology. The most environmentally important impacts were the decrease of soil erosion and retention of crop residues. Experts stated the most significant social impacts as improvement in villages living conditions and sense of belonging to rural areas. Besides, an increase of income and reduction of inputs costs were among the economic impacts of laser levelling technology. According to the results, attitude towards water and soil resources conservation and environmental beliefs had the highest direct effect on individual perception toward impacts. Practical recommendations have been presented based on the results of the study. (shrink)

This paper has two aims. One is to draw a distinction between two types of trust. The other is to argue for its applicability in academic discourse on educational policies. One of the two types of trust is ethical trust that rests on beliefs about others’ ethical virtues. The other is institutional trust that typically depends on law enforcement and economic incentives. Ideas about a social order based primarily on institutional trust have haunted political thought since the time of Thomas (...) Hobbes. Such ideas may seem realistic if we focus on business relations, where conformity to contractual terms suffices to meet the needs of all concerned. Intimate relationships rely more on ethical trust. In the first half of the paper the difference between these two types of trust is explained. In the final sections it is argued that successful schoolwork depends on ethical trust and that measures to make schools more reliable in the institutional sense, through supervision and accountability, need to be applied with caution. Such measures can undermine ethical trust because they, at least implicitly, question the moral integrity of teachers and school-heads. (shrink)

How should actions to redress absolute human deprivation be framed? Current international coordinated actions on absolute poverty are framed by human rights or by goals such as the Millennium Development Goals. But appropriate, effective and sustained responses to needs require localized participation in the definition of those rights/goals/needs and in measures taken to redress them. Human rights or the MDGs do not seem necessarily to require such processes. For this reason some argue that no universal framework can describe (...) economic, social, or cultural rights. Yet to address absolute poverty purely from the local perspective still requires the identification and prioritization of capabilities or needs, and often requires actions by greater-than-local institutions, so in practical terms a framework is not rejected without cost. This paper argues that the identification and prioritisation of rights or MDGs can and should be done at an international level, but that they might be framed as capabilities, and that far greater attention need be given to the iterative specification of these rights, and to the ongoing protection of certain agency freedoms. The paper explores how Wiggins’ account of need can fruitfully inform the specification of needs claims. It also draws significantly on Sen’s work to identify the intrinsic importance of process and opportunity freedoms, and to identify how these can relate to universal priorities. (shrink)

Drawing on anthropological examples of first contacts between people from different cultures, I argue that non-verbal communication plays a far bigger part in intercultural communication than has been acknowledged in the literature so far. Communication rests on mutually attuning in a large number of judgements. Some sort of structuring principle is needed at this point, and Davidson's principle of charity is a good candidate, provided sufficient attention is given to non-verbal communication. There will always be more and less successful interpretations (...) and translations, and their success will depend on the success of the non-verbal communication at hand. There is no need for cognitive or semantic universals: people understand each other because they share (a) certain form(s) of life. How ever, it is incorrect to treat forms of life as rigid entities with clear boundaries: it is both impossible and unnecessary to determine them in an exact way. Any appeal to cognitive or cultural essences to explain how people communicate successfully is flawed. My critique of essentialism is not a defence of linguistic ‘anything goes' relativism whatsoever. Several of my recent Editorials have dealt with terminological/conceptual errors and confusions that have been all too prevalent among psi researchers. In this Editorial, I want to consider a related issue often raised about parapsychological concepts and explanation. Probably we’ve all heard the complaint that parapsychology’s core concepts have only been defined negatively, with respect to our present level of ignorance—for example, taking “telepathy” to be “the causal influence of one mind on another independently of the known senses.” Perhaps some (...) of you have even expressed that complaint yourselves. Of course, the assumption underlying those complaints is that this definitional strategy is a problem. However, it seems like a perfectly reasonable procedure to me, and I can easily accept the possibility that we might eventually learn enough about phenomena so defined that we can later construct better, detailed, and more informative analytical definitions. But at least as far as psi research is concerned, I consider it presumptuous—at our present (and considerable) level of ignorance—to proceed any other way. We hardly have the barest hint, based on all the available data, as to what psi is doing in the world (i.e., both inside and outside the lab). In fact, formal, experimental evidence has been particularly unilluminating. It has barely succeeded, if it’s succeeded at all, in convincing parapsychological fence-sitters that there are any genuine paranormal phenomena to study (I’ve explored some reasons for this in Braude, 1997). And it certainly hasn’t shed light on how pervasive, extensive, and refined psi effects might be, or whether effects of radically different magnitudes would be the result of substantially different processes. At best, typical quantitative research examines only straitjacketed expressions of phenomena that non-laboratory evidence suggests occur more impressively (if not flamboyantly) “in the wild.” So it strikes me as appropriately modest and circumspect to define “PK” (for example) as “the effect of an organism on a region r of the physical world without any known sort of physical interaction between the organism's body and r.” (For additional specific parapsychological definitions, see Braude, 2002). In this paper I focus on a passage of Plato’s Laws that so far has been the object of little study (V 731d-732b). In the Laws, the origin of all evil is neither an ontological principle, as in the Judaeo-Christian tradition, nor a simple lack of knowledge (àghnoia) or a lack of knowledge combined with the false presumption of knowledge (amathìa). Rather, in this passage amathìa itself is traced back to “excessive self-love” (sphòdra heautoû philìa). I show that this “excess” (...) has a specific “anthropological” relevance, because it is not limited to the intellectual sphere or to the will, but directly concerns the human way of loving. The thesis that I argue for in this paper is that this “excess” is a possibility implicit in the human being qua àplestos, and should therefore be interpreted in an “anthropological” sense: it does not indicate a simple “lack” of balance, but rather a possibility and a risk to which humans expose themselves when they exceed the homeostatic balance of needs typical of non-human animals. Finally, I trace the various steps of this “anthropology of excess” back to its origin: the image of the leaky jar found in the Gorgias. (shrink)

The thinking employed by Homo faber, Latin for ‘Tool Wo/Man,’ and a concept articulated by Hannah Arendt and Max Scheler referring to humans as controlling the environment through tools, is instrumental in nature. Know-how is applied to the environment as one would apply a tool, in order to control it. In contrast, thinking that looks at how to engage the whole for the sake of solving a problem, is the thinking employed by Homo Cognoscens (a term I invented), referring to (...) the Examining/Inquiring Wo/Man, from the Latin cognosco, which means ‘I inquire/examine.’ In my essay, I show why it is important to move beyond the limited thinking of Homo faber. Homo faber in some sense still views itself at the center of the universe and capable of controlling it. S/he lives in a geocentric worldview. Homo cognoscens has a heliocentric worldview. Homo cognoscens understands that the world is interconnected and that we do not control the universe literally or figuratively no matter how advanced our knowledge. Instrumental thinking also does not lend itself to developing self-knowledge, for it doesn’t involve awareness of the thinking that goes into solving problems “out there.” It simply applies reason for the purpose of solving problems. We tend to reason things through, but rarely to think through our reasoning. Yet, we live in an interconnected world and we are interconnected with the world we live in. Our thinking reflects our interconnectedness and we have to be able to view it critically and self-critically. Homo cognoscens restores our relationship with the world and other people. Homo faber has gone too far in its instrumental thinking and destroyed relationship in the process. Everything has become instrumental. To move beyond Homo faber is to evolve to Homo cognoscens and understand how we are intrinsically connected to the world we depend on and need to engage it, rather than assume we can control it at all cost. Does critical theory still need psychoanalysis? In Critique on the Couch, Amy Allen offers a cogent and convincing defense of its ongoing relevance. Countering the overly rationalist and progressivist interpretations of psychoanalysis put forward by contemporary critical theorists such as Jürgen Habermas and Axel Honneth, Allen argues that the work of Melanie Klein offers an underutilized resource. She draws on Freud, Klein, and Lacan to develop a more realistic strand of psychoanalytic thinking that centers on notions of loss, negativity, ambivalence, (...) and mourning. Far from leading to despair, such an understanding of human subjectivity functions as a foundation of creativity, productive self-transformation, and progressive social change. At a time when critical theorists are increasingly returning to psychoanalytic thought to diagnose the dysfunctions of our politics, this book opens up new ways of understanding the political implications of psychoanalysis while preserving the progressive, emancipatory aims of critique. While the mainstreaming of the far right is attracting growing scholarly interest based on its contemporary relevance, the role that far-right self-representation strategies play in this process has seen limited engagement. In this article, we argue that far-right actors employ a post-fascist logic to bring their ideas closer to the mainstream. This logic rests on a dual message, whereby they attempt to outwardly distance themselves from fascism while at the same time recontextualising fascist ideas. To explore these dynamics, we use (...) a mixed-methods approach to discourse analysis to examine far-right social media posts during the 2022 Italian general election. Taking all Facebook, Instagram and Twitter posts during the official campaigning period from the party and leader accounts of Lega per Salvini Premier and Fratelli d’Italia, we explored articulations of the post-fascist dyad within this context. Our findings underscore how both far-right parties ridiculed accusations of fascism and depicted themselves as ‘centre-right’, yet they commonly used fascist dog-whistles and violent anti-immigration discourse to construct a broader conspiracy narrative and portray themselves as Italy's saviour. While Italy proves a paradigmatic case, this research has wider implications for the need to explore the relationship between self-representation and mainstreaming. (shrink)

Social obligation begins far before people establish explicit cooperative relationships. Research on trust suggests that people feel obligated to trust other people even at zero acquaintance, thus trusting complete strangers even though they privately expect to be exploited. Such obligations promote mutually beneficial behavior among strangers and likely help people build goodwill needed for more long-lasting relationships.

As researchers we often find ourselves grappling with social media platforms and data ‘at close quarters’. Although social media platforms were created for purposes other than academic research – which are apparent in their architecture and temporalities – they offer opportunities for researchers to repurpose them for the collection, generation and analysis of rich datasets. At the same time, this repurposing raises an evolving range of practical and methodological challenges at the small and large scale. We draw on our experiences (...) and empirical data from two research projects, one using Facebook Community Pages and the other repurposing Facebook Activity Logs. This article reflects critically on the specific challenges we faced using these platform features, on their common roots, and the tactics we adopted in response. De Certeau’s distinction between strategy and tactics provides a useful framework for exploring these struggles as located in the practice of doing social research – which often ends up being tactical. This article argues that we have to collectively discuss, demystify and devise tactics to mitigate the strategies and temporalities deeply embedded in platforms, corresponding as far as possible to the temporalities and the aims of our research. Although combat at close quarters is inevitable in social media research, dialogue between researchers is more than ever needed to tip the scales in our favour. (shrink)

The response to feeding needs in advanced dementia patients is a subject of ethical inquiry. Advanced dementia is the debilitating result of a range of neurodegenerative diseases. As this terminal illness progresses, patients develop mild to severe dysphagia that can make swallowing difficult. Of the two available options, artificial tube feeding or oral hand feeding, an estimated one-third of these patients will receive artificial tube feeding. However, observational studies have failed to validate the clinical benefits of tube feeding. Ethics (...) of care, the feminist philosophical perspective, and Ubuntu philosophy offer arguments for the choice of oral hand-feeding as a preferrable first option by caregivers as far as possible. These moral theories acknowledge that human beings can be dependent for long periods, mostly early and later years of life. Both views reflect an approach that draws people into a system of interdependent caring relationships. They encourage hand feeding as a way of exhibiting solidarity and respecting human dignity even at the end of life. (shrink)

Information communication technology is spreading fast and wide. Driven by convenience, it enables people to undertake personal tasks and make decisions more easily and efficiently. Convenience enjoys an air of liberation as well as self-expression affecting all areas of life. The industry for children's toys is a major economic market becoming ever more tech-related and drawn into the battle for convenience. Like any other tech-related industry, this battle is about industry dominance and, currently, that involves networked toys. Networked toys aim (...) to enhance convenience for children and parents alike. Increasingly difficult to resist, these convenient networked devices are also a societal game changer. Neatly nestled in a lacuna juris and surrounded by a lack of clinical evidence, networked toys raise complex ethical issues concerning human development. This article lays bare the regulatory nexus for networked toys and invites ethical thinking to fill the gap to ensure sufficient protection for all human developmental stages. Networked toys not only affect but also might interfere with child development. Therefore, the article initially summarises the four key psychological stages through which the neurological development of the human brain processes. Each of these stages involves vital windows for human development in cognitive, emotional and social dimensions. Missing any of these developmental windows changes an individual human for life. The article then takes a look at the two main legal frameworks protecting the stages of human development which are applicable to networked toys: First, the examination of the human rights framework with its major segments emanating from the fundamental rights to privacy for family and home, to a child's education as well as to personal data reveals the use of current networked toys as a shielded part of parenting which tends to be at odds with privacy and data protection requirements. Second, the product liability framework for toy manufacturers requires evidence-based causality for putting a child's safety at risk. Unfortunately, these legal frameworks fail to offer sufficient protection of the human developmental stages. There is a lacuna juris. Although networked toys involve the risk of negatively impacting human development in every dimension, clinical psychological studies are impossible to acquire as court evidence for product liability because they take too long to provide reliable data while exposing several generations of children to the examined risk in the process. Meanwhile the temptation of convenience continues to drive the industry and consumers of networked toys and devices, which are already impacting children of all age groups. Accepting this phenomenon as an element of cognitive dissonance in society and in science falls far short of an appropriate ethical balance. The need for creating such an ethical balance concerning networked toys is all the more imperative because even if the networked toy industry managed to eliminate all psychological risks for human development and every legal conflict with privacy and security, significant ethical and societal risks of networked toys remain due to inevitable technological bias. Against these mounting changes, it is suggested that only an ethical approach of interdisciplinary research and learning seems most promising to develop an appropriate equilibrium between the complex challenges posed by networked toys and the societal values at stake. This paper has a twofold purpose. First, it aims at highlighting one difference in how counterfactuals work in general history, on the one hand, and in history of the natural sciences, on the other hand. As we show, both in general history and in history of science good counterfactual narratives need to be plausible, where plausibility is construed as appropriate continuity of both the antecedent and the consequent of the counterfactual with what we know about the world. However, in general (...) history it is often possible to imagine a consequent dramatically different from the actual historical development, and yet plausible; in history of science, due to plausibility concerns, imagining a consequent far removed from the results of actual science seems more complicated. The second aim of the paper is to assess whether and to what degree counterfactual histories of science can advance the cause of the so-called “contingency thesis,” namely, the claim that history of science might have followed a path leading to alternative, non-equivalent theories, as successful as the ones that we currently embrace. We distinguish various versions of the contingency thesis and argue that counterfactual histories of science support weak versions of the thesis. (shrink)

Sorensen has argued that one can exploit the vagueness of an ordinary predicate like ‘small’ to induce a sort of vagueness in ‘vague’, by constructing a series of predicates of the form ‘n-small’, where x is n- small if and only if x is small or x n. The resulting ‘Sorensen’ed’ predicates present a Sorites case for ‘vague’ ; hence the vagueness of ‘vague’. Hyde argues that this demonstrates that all vague predicates are higher-order vague. Others doubt whether Sorensen’s series (...) really delivers such a result, claiming Hyde’s argument to be either: unsound, because it misidentifies the true source of vagueness in Sorensen’s Sorites ; invalid, because it fails to generalize to all vague predicates ; or circular, because it presupposes the very thing it tries to prove, namely, higher-order vagueness. This paper contributes to the Sorensen-Hyde vs. Tye-Deas-Hull-Varzi debate by clarifying the relations between vague vagueness and higher-order vagueness. I show how claims of higher-order vagueness are derivable from claims of vague vagueness. This is the missing piece needed to complete Hyde’s argument and overcome the objections presented by Deas, Hull, Tye, and Varzi. I then show how Sorensen’s considerations, once properly generalized, pose more far-reaching consequences about the vagueness of ‘vague’ than either defenders or critics of Hyde’s argument have appreciated. I MAKE NO APOLOGIES for writing about this well-worn topic. For, although there has been an enormous amount written about the account Hume gives of the nature of moral evaluation, commentators are as far from agreement as ever. My own contribution to the controversy has, if anything, not only added to the variety of opinions but also has increased the general confusion. For this I must accept some responsibility. I have certainly laid myself open to some misinterpretation, and the view (...) I have so far expressed in print may also need some modification. I shall here attempt to clarify what precisely my view now is, and why I prefer it to some alternative views advanced by those who find my interpretation of this aspect of Hume's philosophy unacceptable. II. Since what I want to defend is in all important respects my earlier interpretation of the Treatise, 2 I shall for the most part, though not exclusively, be concerned with what Hume says in this, his early, but major, work. Abstract I consider Paul Thompson’s Agrarian Vision from the perspective of the philosophy of technology, especially as it relates to certain questions about public engagement and deliberative democracy around food issues. Is it able to promote an attitudinal shift or reorientation in values to overcome the view of “food as device” so that conscientious engagement in the food system by consumers can become more the norm? Next, I consider briefly, some questions to which it must face up in order to (...) move closer in dismantling the barriers that inhibit the capacity for virtuous caretaking of the food system at various levels. Lastly, and more deeply, how successful might agrarianism be in inculcating citizenship values (ones that go beyond food ethics as a private affair), for the democratization of agricultural technologies? Might the Jeffersonian foundation to which the agrarianism (a la) Thompson appeals need something like a contemporary theory of justice in order to facilitate the reconstitution of our politico-moral selves? This paper attempts to get some critical distance on the increasingly fashionable issue of realism in political theory. Realism has an ambiguous status: it is sometimes presented as a radical challenge to the _status quo_; but it also often appears as a conservative force, aimed at clipping the wings of more ‘idealistic’ political theorists. I suggest that what we might call ‘actually existing realism’ is indeed a conservative presence in political philosophy, and that its ambiguous status plays a part in (...) making it so. But I also argue that there is no necessary connection between realism and conservatism. This paper describes the three contingent and suspiciously quick steps which lead from an initial commitment to being attentive to the real world, via a particular kind of pessimism about political possibilities, to an unnecessarily conservative destination. In the process, I try to show how the ubiquitous trinity of realism, pessimism and conservatism might be pulled apart, thus removing the artificial tension between ‘being realistic’ and the demand for far-reaching social change. This article questions this position on three counts: one, the hurt these cartoons cause to the Muslims and the resulting frictions between Europe and leaders of the Muslim countries; two, the harm they cause to European (...) societies by increasing the tension between Muslims and ordinary citizens and the state at a time when Islamophobia and anti-immigrant feelings are already high; and, three, the need to question the intent of those publishing the cartoons given the overwhelming evidence on the first two counts. The article also questions the legitimacy and usefulness of labelling attacks triggered in response to these publications as ‘Islamic terrorism’ when the profiles of those perpetuating these attacks show criminal and deviant behaviour than evidence of religious devotion. There is a gap between health economic evaluation methods and the value judgments of coverage decision makers, at least in Germany. Measuring preference satisfaction has been claimed to be inappropriate for allocating health care resources, e.g. because it disregards medical need. The existing methods oriented at medical need have been claimed to disregard non-consequentialist fairness concerns. The aim of this article is to propose a new, contractarian argument for justifying needs-based economic evaluation. It is based on consent rather than (...) maximization of some impersonal unit of value to accommodate the fairness concerns. This conceptual paper draws upon contractarian ethics and constitution economics to show how economic evaluation can be viewed as an institution to overcome societal conflicts in the allocation of scarce health care resources. For this, the problem of allocating scarce health care resources in a society is reconstructed as a social dilemma. Both disadvantaged patients and affluent healthy individuals can be argued to share interests in a societal contract to provide technologies which ameliorate medical need, based on progressive funding. The use of needs-based economic evaluation methods for coverage determination can be interpreted as institutions for conflict resolution as far as they use consented criteria to ensure the social contract’s sustainability and avoid implicit rationing or unaffordable contribution rates. This justifies the use of needs-based evaluation methods by Pareto-superiority and consent. The view of economic evaluation presented here may help account for fairness concerns in the further development of evaluation methods. This is because it directs the attention away from determining some unit of value to be maximized towards determining those persons who are most likely not to consent and meeting their concerns. Following this direction in methods development is likely to increase the acceptability of health economic evaluation by decision makers. (shrink)

Bad philosophy is responsible for the climate and nature crises, and other global problems too that threaten our future. That sounds mad, but it is true. A philosophy of science, or of theatre or life is a view about what are, or ought to be, the aims and methods of science, theatre or life. It is in this entirely legitimate sense of “philosophy” that bad philosophy is responsible for the crises we face. First, and in a blatantly obvious way, those (...) institutions, organizations, corporations, businesses, endeavours, and activities of humanity that cause the crises and global problems we face, do so because of the aims they pursue (profit perhaps, or power, or heat and light for homes), and the methods adopted in pursuit of those aims – the philosophy in other words, built into the institution, organization, business, human activities, or whatever it may be. It is the philosophy of these institutions, organizations and activities that we need to change to put a stop to, or at least lessen the severity of, the crises we face, the global problems that confront us, above all the climate and nature crises. One institution has an especially crucial role in this respect: our universities. They are dominated in a multitude of ways by a particularly disastrous philosophy, a philosophy of inquiry which may be called knowledge-inquiry. This holds that the basic aim of the university is to acquire and apply knowledge. First, knowledge is to be acquired; once acquired, it can be applied to help solve social problems. But this philosophy of knowledge-inquiry is an intellectual disaster. As a result, universities are, in devastating and almost entirely unrecognized ways, humanitarian disasters too. Judged from the standpoint of helping to promote human welfare, the university shaped by the philosophy of knowledge-inquiry violates THREE of the four most elementary rules of rational problem solving conceivable in a wholesale, structural fashion, and it is this gross, wholesale, structural irrationality of the university, unnoticed by all but a few scientists and scholars, that is in part responsible for the creation of our grave global problems, and our current incapacity to learn how to solve them. The pursuit of knowledge, conducted in universities, within the framework of knowledge-inquiry over the decades and centuries, has produced much of great benefit to humanity. It has made the modern world possible. It has led to modern power production, modern industry and armaments, modern agriculture, modern hygiene and medicine, modern travel and communications, and the internet. But these very successes have also created many of our most serious current global problems: the climate crisis; the destruction of natural habitats, the catastrophic loss of wild life, and impending mass extinction of species (the nature crisis); the lethal character of modern war; the impact on the natural world of the rapid growth of the human population; the menace posed by nuclear weapons; pollution of earth, sea and air; threats to democracy caused in part by the internet and social media. All these grave global problems have been made possible by modern science and technology, pursued largely in universities within the framework of knowledge-inquiry. Nevertheless, it is not science and technology as such that are the problem, but science pursued in a way that is dissociated from a more fundamental task of the university to help humanity resolve conflicts and problems of living in increasingly cooperatively rational ways, so that progress may be made to a better world. Science and technology, pursued within the framework of knowledge-inquiry, create for some of us the power to act, but not the power to act wisely – not the power to learn how to resolve conflicts and problems of living in increasingly cooperatively rational ways. For that, we need our institutions of learning, above all our universities, to take as their primary task to help humanity learn how to do it. In order to do that, the philosophy of inquiry put into practice by universities needs to be dramatically transformed. We urgently need to bring about a revolution in the overall aims and methods of academic inquiry – a revolution in the philosophy of the university, all around the world, wherever possible, so that the basic aim becomes to seek and promote wisdom, construed to be the capacity, active endeavour, and perhaps desire, to realize what is of value in life, for oneself and others, wisdom in this sense including knowledge, understanding and technological know-how, but much else besides, methods being dramatically modified too so as to help achieve the new academic aim. The basic task of the university would be, not to solve problems of knowledge, but rather to help people in the social world beyond the university to resolve conflicts and problems of living so that what is of value in life may be realized by everyone, insofar as that is possible. The pursuit of knowledge would be vital, but not intellectually fundamental. The intellectual and institutional revolution we so urgently need in our universities would affect every discipline and aspect of the university; it would dramatically affect both research and education, and the whole way the university is related to the rest of the social world. The revolution, from knowledge-inquiry to wisdom-inquiry would dramatically enhance the intellectual integrity and rationality of natural science, social inquiry, the humanities and technology, the character of these disciplines and the relationships they have with one another. University education throughout the university would be dramatically improved. And academic inquiry as a whole would do what, on the whole, it fails to do at present: it would help humanity resolve conflicts and problems of living in increasingly cooperatively rational and, as a result, increasingly successful ways, progress at last being made to a genuinely good, civilized world – a world in which there is peace, justice, liberal democracy, individual freedom, education, reasonable equality, sustainable prosperity and worthwhile opportunities in life, all of these for everyone, insofar as this is possible. Why, it may be asked, has academic philosophy not noticed that we urgently need to transform the current bad philosophy of inquiry of knowledge-inquiry into the far more intellectually rigorous and humanly valuable philosophy of wisdom-inquiry, so that we can begin to do what so far we have failed to do so lamentably: learn how to avoid impending disasters, and even make progress to a better world, something that seems at present almost unthinkable given the horrors of war, poverty, political enslavement of the 20th century, and the horrors of this century so far too? The answer is that academic philosophy is in a particularly pitiful state, as philosophers themselves, are just beginning to realize and lament. That is why academic philosophers are blind to the intellectual and humanitarian disaster of the bad philosophy that dominates universities today, and inconceivable to them to them that they might have, as a disciplinary task, to ensure academic inquiry implements a good philosophy of inquiry, and advocate and argue for change if it does not. Once upon a time, in Europe at least, philosophy was an intellectual power in the world. In the 17th century it created modern science which massively increased and improved our knowledge and understanding of the world, which in turn led to the Enlightenment, the industrial revolution, and the modern world. Philosophy was once so intellectually powerful and influential that it changed the course of history. But philosophy also made in the past three disastrous intellectual blunders: the post-Cartesian blunder, the post-Newtonian blunder, and the Enlightenment blunder. Never acknowledged and corrected by subsequent philosophy right down to the present, these unrecognized intellectual blunders rendered academic philosophy the esoteric, pathetic, and powerless discipline it is today, so that throughout the last century and, so far, throughout this one, academic philosophy has remained blind to the intellectual disaster of knowledge-inquiry, and thus failed entirely to take up its proper disciplinary task of warning fellow academics of the structural irrationality of the philosophy that prevails in the university, and of proposing what steps need to be taken to put things right. Instead of performing such an urgently needed philosophical task, so-called analytic philosophy was reduced to analysing the meaning of words. Since then, there has been hardly any discernible improvement, even if analysis of concepts no longer dominates the scene. Bad academic philosophy is indeed responsible for intellectual and humanitarian failures of the university. What the three past intellectual blunders of philosophy are, why their persistence so dramatically reduces academic philosophy to a triviality, and why, furthermore, this results in the failure of scientists and scholars to see what is so blatantly bad about the philosophy prevailing in universities around the world – the failure to see what so urgently needs to be done to put right what has been wrong for so long: all this is made clear in this book. A new kind of philosophy emerges during the course of the argument, critical fundamentalism, which has as its task to keep alive imaginative and critical – that is rational – thinking about our fundamental problem: How can our human world, the world we experience and live in – the world of living things, people, consciousness, free will, meaning and value – how can all of this exist and best flourish embedded as it is in the physical universe? That problem encompasses all others of life, science and thought. Critical fundamentalism tries to improve answers to aspects of this problem; but it also seeks to encourage everyone to think about the problem, from time to time, and think about how it interacts, in both directions, with more urgent particular and specialized problems of life and thought. Critical fundamentalism sets out to help improve bad philosophy wherever it is to be found: in social, political, commercial, legal, financial, and international life; and especially in academia, in institutions of learning, so that they become devoted to enhancing the capacity of people to learn how to achieve what is of genuine value in this brief life of a few decades if we are fortunate. Critical fundamentalism does everything it can to bring about the revolution in our universities we so urgently need. If taken up by mainstream philosophy, it might really have an impact, and begin to transform universities for the better, in both intellectual and humanitarian terms, and thus, enable humanity to learn how, after the grim failures and horrors of the last century and this one, to make progress to a better world. -/- . Hagberg ALTHOUGH IT WENT ON in smaller numbers in earlier decades, the fact that there were legions of expatriate jazz musicians fleeing to a far more appreciative Europe in the 1960s and 1970s shows how important a cultural event Ken Burns's documentary (...) on the first century of jazz really is. Those expatriate players were all but forced out by a rapidly diminishing audience and a corresponding lack of appreciation for their artistic achievements and abilities. It is in any social context an achievement to gain an audience for an undervalued artform of between three and four million viewers for nineteen hours; to have done so against the backdrop of the fact—one bitter to swallow for so many American players of those years—that the country of origin for this artform was so slow to significantly value it, makes this documentary almost a form of cultural emergency-relief. But it also raises the stakes in how jazz is represented, which of its features are focused upon, and what kind of story is told about its development. In my opinion the film makes deeply serious errors in each of these ways—almost to the point of turning this seemingly magnificent gift to jazz into a Trojan horse—but here I'd like to focus on five of the features of jazz as an art that I think make jazz particularly difficult to portray in a reduced or simplified form. To put the point a bit more strongly: without an awareness of (at the least) these five features of jazz, any attempted portrayal would run the very serious danger of engendering or further nurturing the very incomprehension of the artistic or aesthetic achievements of jazz that drove all those American players to Copenhagen, Paris, London, Munich, Vienna, and Amsterdam in the first place. It is, in short, necessary to provide at least a sense of what is [End Page 188] intrinsically problematic about the artform to illuminate both its distinctive nature and the aesthetic problems—taken by its practitioners as its internally generated artistic challenges—that give this artform its dynamic energy.First, there is the fundamental question concerning the metaphysics of a jazz piece, i.e., what kind of thing it is. At a glance one can see that a familiar attempt to answer this question within the larger field of the aesthetics of music, i.e., the identification of the work with the score, will have precious little plausibility when applied to jazz. As any jazz musician or aficionado knows, jazz pieces that become "standards" are pieces that are performed countless times, in innumerably variegated ways, and what is usually of greatest interest about any given performance of a standard is not, indeed, how well or to what extent it instantiates a predetermined ideal of the piece as specified in the score, but rather how it departs from, or adds distinctive interpretive content, to the basic structure of the piece. This aesthetically significant fact is reflected in the correlated common practice of using, not scores, but rather schematic "lead sheets" that provide the very basic harmonic and melodic material of the piece. Even larger-ensemble pieces, e.g., the scores of Duke Ellington, are notated only in the sectional writing; the improvisational sections—the sections that many would say give the distinctive life to any given performance—are of course not notated. There are fully notated scores of many—to use a dangerously complicated word—classic jazz performances, but in jazz parlance these, here again with aesthetic significance, are not called scores, but rather transcriptions, and in this improvisational artform it would be cause for suspicion rather than congratulation if a player were to perform a given work exactly in accordance with the transcription repeatedly. Novelist and social activist Alice Walker coined and defined colorism as the “prejudicial or preferential treatment of same‐race people based solely on their color,” according to Kimberly Jade Norwood and Violeta Solonova Foreman. For Norwood and Foreman, colorism is concerned with the lightness and darkness of skin tone, with preference given to whiteness. This article explores Karl Barth's early and later understanding of the incarnation with a view toward answering two very important theological questions: did Barth so historicize his Christology in his doctrine of Reconciliation that he could no longer accept his own earlier view that “His Word would still be His Word apart from this becoming [incarnate], just as Father, Son and Holy Spirit would be none the less eternal God, if no world had been created”? Or did his earlier view (...) enable him to present a more powerful understanding of how God himself was at work in the history of Jesus of Nazareth and in human history effecting the reconciliation of the world both from the side of God and from the human side? This article argues that Barth never historicized his Christology to such an extent that he ever would have espoused the idea that Jesus' human history “constituted” his being as the second person of the Trinity, since any such thinking undermines Barth's belief that Jesus' divinity must be recognized as “definitive, authentic and essential” if it is to be truly recognized at all. It is further argued that those who do espouse this view have confused epistemology and ontology by mistakenly assuming that since we cannot know the eternal Trinity except through the human history of Jesus as the incarnate Word, that must mean that the eternal Word never existed without that human history so that, strictly speaking, we can no longer distinguish between the immanent and the economic Trinity and the logos asarkos and logos incarnandus . This article suggests that those who hold that God realizes his own eternal being by suffering and dying for us have missed a crucial point of Barth's trinitarian doctrine which is that God realizes his purposes for us in the suffering, death and resurrection of Jesus, but that he did not thereby realize his own being as the triune God, since God's eternal being and act does not need any realization by virtue of the fact that God is perfect and acts toward us in the overflow of that perfect love in perfect freedom. Tachiaraware monism is his attempted counter-argument to the Cartesian dualism of the object–subject divide, or in his words, a divide between physical (butsuri, mono, science, object) and non-physical consciousness (ishiki, koto, perception, incident), perception (chikaku, 知覚) and conception (shikō, 思考). His concept of Kasane-egaki is (...) also often cited as a core concept of his theory of time.1 The main aim of this paper is to first overview the works of Ōmori since there is only a limited amount of his translated work so far.2 Consecutively, the paper focuses on Ōmori’s theory of kotodama and its related arguments with an intention to expand his concept of Kowaburi into the ethics of online encounters during the pandemic.The world in 2020 was suddenly forced to face the pandemic caused by COVID-19. What COVID-19 alerted us to is tremendous, and there are countless problems that the invisible virus has revealed. Among those are the hidden problems of contemporary society, not limited to the discrimination among races, gender, and jobs (white-collars versus essential workers), the problem of zoonosis, and the related environmental problems (climate change and intrusion into wild nature) caused by over-exploitation of nature. In developed countries, most students and those serving as intellectual workers face their daily lives being overly occupied with online lectures and meetings. COVID-19 worked to normalize remote work, which further normalized and forced our everyday life to shift to cyberspace. [End Page 101]In introducing and overviewing Ōmori’s philosophy, this paper attempts to see the current situation through Ōmori’s philosophy to draw out some ethical implications related to non-physical online encounters and how we can perceive human interactions and relationships under such conditions. Under the constraints caused by COVID-19, humans’ limitless desires to interact with others are expanding more so to the sphere of cyberspace, leading to technological development, such as VR. In short, first, the paper overviews Ōmori’s philosophy. Second, through the overview of Ōmori’s philosophy, the paper seeks adaptable philosophy of his that may work as soft binding grounding ethics for cyberspace encounters where substantial bodily encounters are void. In doing so, the paper intends to draw out weak binding ethics implied in Ōmori’s philosophy that may work to empathetically engage with others in cyberspace where embodied encounters with others are dissolved.Ōmori Shōzō and His Philosophy: A Short Introduction and OverviewIn his short essay introducing the Japanese philosophy of the 1970s, Yasuo Kobayashi coined the term “Komaba quartet” by selecting four active eminent philosophers based on the Komaba campus at the University of Tokyo.3 Among them is Ōmori Shōzō (1921–97), aligning with Hiromatsu Wataru (1933–94), Sakabe Megumi (1936–2009), and Inoue Tadashi (1926–2014). Ōmori is the oldest of the Komaba quartet and received higher education before World War II. He served at the Naval Technology Institute Mitaka Laboratory during the war with his physics degree from the Tokyo Imperial University.4 After the war, he studied philosophy at the University of Tokyo with an interest in phenomenology, leading him to study at Harvard and Stanford in the United States.During his professorship at the University of Tokyo, he inspired countless students who are now leading the philosophy academy in Japan, such as Noe Keiichi (1949–) and Noya Shigeki (1954–). In the round-table discussion titled “Explanatory Round-Table on the Charm of Ōmori’s Philosophy,” four of his former students—Iida Takashi and Tanji Nobuharu, in addition to Noe and Noya—worked on selecting his works. According to Mathias Risse and Richard Zeckhauser, racial profiling can be justified in a society, such as the contemporary United States, where the legacy of slavery and segregation is found in lesser but, nonetheless, troubling forms of racial inequality. Racial profiling, Risse and Zeckhauser recognize, is often marked by police abuse and the harassment of racial minorities and by the disproportionate use of race in profiling. These, on their view, are unjustified. But, they contend, this does not mean that all (...) forms of racial profiling are unjustified; nor, they claim, need one be indifferent to the harms of racism in order to justify racial profiling. In fact, one of the aims of their paper is to show that racial profiling, suitably understood, “is consistent with support for far-reaching measures to decrease racial inequities and inequality.” Hence, one of their most striking claims, in an original and provocative paper, is that one can endorse racial profiling without being in any way indifferent to the disadvantaged status of racial minorities. In an initial response to these claims, I argued that Risse and Zeckhauser tend to underestimate the harms of racial profiling. I suggested two main reasons why they did so. The first is that they tend to identify the more serious harms associated with profiling with background racism, and therefore to believe that these are not properly attributable to profiling itself. The second reason is that they ignore the ways in which background racism makes even relatively minor harms harder to bear and to justify than would otherwise be the case. Hence, I concluded, racial profiling cannot be a normal part of police practice in a society still struggling with racism, although under very special conditions and with special regulation and compensation in place, it might be justified as an extraordinary police measure. I want to stand by those claims. However, Risse’s response to my arguments persuades me that I misinterpreted his earlier position in one significant respect. So I will start by explaining what interpretive mistake I believe that I made.
